Nintendo Sues Accessories Company For Sharing Switch 2 'Mockup' Months Before Official Reveal

This controversy erupted around CES 2025 in January when Genki showcased their mockup, claiming it was based on an actual Switch 2 system they had seen and used to design their accessories.

According to court documents obtained by IGN, Nintendo alleges that Genki engaged in a deliberate campaign to exploit public interest in the upcoming console. The lawsuit cites trademark infringement, unfair competition, and false advertising. Nintendo claims Genki boasted about having early access to the unreleased console, allowing attendees to interact with the mockups. The company argues that Genki's assertions about accessory compatibility with the Switch 2 were misleading, as such guarantees would require unauthorized access to the console.

The court papers highlight that in January 2025, Genki began advertising their supposed unauthorized access to the Switch 2, despite the console not being publicly revealed by Nintendo at that time. Genki's statements have been inconsistent, later claiming they never possessed a console, yet maintaining that their accessories would be compatible with the Switch 2 upon its release.

A tweet from Genki's CEO, Edward Tsai, and a pop-up on their website, hinting at secrecy and unauthorized access, have particularly irked Nintendo.

Nintendo is seeking an injunction to prevent Genki from using the "Nintendo Switch" name in their marketing, the destruction of any products or marketing materials referencing Nintendo's branding, and unspecified damages, which they request be tripled.

In response, Genki issued a statement over the weekend, acknowledging the lawsuit and their commitment to addressing it with legal counsel. They emphasized their independence and dedication to creating innovative gaming accessories, expressing pride in their work and reaffirming the quality and originality of their products. While unable to comment in detail, Genki noted their ongoing preparations for fulfilling orders and showcasing new products at PAX East. The company thanked supporters and reiterated their focus on developing gear for gamers.

The Nintendo Switch 2 is scheduled to launch on June 5, with pre-orders starting on April 24 at a price of $449.99, which were met with high demand.
